Welcome to Wellhouse Media LLC ("Company," "we," "us," or "our"). By using our website and services, you agree to comply with the following Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
1. Services Provided
● We provide media production services, including photography and videography for small businesses, local influencers, realtors, and homeowners.
2. User Responsibilities
● You agree to provide accurate and complete information when using our services.
● You are responsible for obtaining any necessary permissions or release forms for individuals or locations featured in your videography or photography. We can assist you in obtaining these releases for an additional fee.
● You agree to comply with all applicable laws, including intellectual property and privacy laws
3. Limitations of Liability
● We are not liable for any damages or losses resulting from the use of our services, except in cases of gross negligence or willful misconduct. This includes, but is not limited to, issues related to data loss, service interruptions, and non-compliance with local regulations regarding drone footage.
● We are not responsible for any issues arising from the failure to obtain necessary permissions or release forms.
4. Refund Policy and Edits
● We offer a refund policy as outlined in our separate policy document. Clients are entitled to one set of complimentary edits. Any further edits can be purchased for an additional fee.
● Refunds will not be provided after the service has been performed. Specifically, once our representative arrives at the scheduled appointment to shoot your project, no refunds will be issued. Please review your project details carefully prior to the appointment.
5. Intellectual Property
● All content created by Wellhouse Media LLC is protected by copyright and other intellectual property laws.
You may not use, distribute, or reproduce any of our content without our express written permission.
6. Termination
● We reserve the right to terminate your access to our services if you deliberately falsify information or violate these Terms
7. Dispute Resolution
● In the event of a dispute arising from these Terms or our services, both parties agree to attempt to resolve the dispute through mediation before pursuing legal action. Mediation will take place in the state of Tennessee.
8. Governing Law
● These Terms shall be governed by and construed in accordance with the laws of the state of Tennessee, without regard to its conflict of law principles.
9. Force Majeure
● We are not liable for any delays or failure to perform our obligations under these Terms due to events beyond our control, including but not limited to natural disasters, acts of war, pandemics, government regulations, strikes, or interruptions in utility services. Such events shall constitute force majeure, excusing us from performance of our obligations.
10. Indemnification
● You agree to indemnify and hold Wellhouse Media LLC, its affiliates, officers, employees, and agents harmless from any claims, damages, liabilities, costs, or legal fees arising from your use of our services, your breach of these Terms, or your violation of any law or the rights of a third party. This indemnification obligation will survive the termination of these Terms.
